ICE Detention Has Hit Record Levels - and Most People Held Have No Criminal Conviction

The number of people held in Immigration and Customs Enforcement detention has climbed to what multiple news outlets have reported as a record high, and according to federal data, most of them have no criminal conviction at all.

As of July 11, 2026, ICE held 65,765 people in detention, according to records compiled by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University. The figure reflects an enforcement surge under the Trump administration that Politico reported is still expanding, and outlets including ABC News and the Deseret News reported ICE detention and arrests hitting record highs through the summer of 2026.

Of those 65,765 people, 46,436 had no criminal conviction, or 70.6 percent, the TRAC data shows. That means roughly seven of every ten people detained were held on immigration violations alone, not on any criminal record.

The detail matters because detention has often been described publicly as a tool aimed at people with criminal histories. The data points the other way. The largest share of the detained population is made up of people whose only violation is related to their immigration status.
