Supreme Court Lets Arizona Prison Healthcare Takeover Begin Oct. 19

Updated Oct 8, 2026
The U.S. Supreme Court has refused Arizona’s last-minute request to delay a court-ordered takeover of healthcare in the state prison system. The decision leaves an outside corrections professional scheduled to assume control of healthcare management for roughly 25,000 incarcerated people on Oct. 19.
Arizona sought a pause while it appeals both the receivership order and the appointment of former Ohio corrections director Annette Chambers-Smith. Justice Elena Kagan denied the emergency request, allowing the transition to proceed while those appeals continue.
The Immediate Change Is Management, Not the End of the Lawsuit
The state remains free to pursue its appeal, but the denial means the receivership does not wait for that process to finish. The outside manager is set to begin overseeing healthcare operations on the date already established by the lower court.
The Takeover Follows More Than a Decade of Litigation
Federal courts found serious constitutional problems in Arizona prison healthcare and concluded that required improvements had not been completed. The receivership was ordered after years of litigation, monitoring and enforcement efforts.
Arizona Says Its Recent Improvements Deserve More Time
The state has argued that staffing, spending and healthcare systems have improved and that a takeover is an extraordinary remedy. The lower courts nevertheless allowed the receivership to move forward, and the Supreme Court did not stop it at the emergency stage.
Oct. 19 Becomes the Operational Deadline
The next visible consequence is therefore concrete: who manages prison healthcare. Unless another court order intervenes, Chambers-Smith’s receivership begins Oct. 19 even as Arizona continues its legal challenge.
